SBDC: Legal Considerations for Restaurants in So. IL During the Pandemic
With the issuance of Executive Order Numbers 56 and 70, restaurants in Southern Illinois face new restrictions that could significantly impact how they operate. Additionally, lawsuits already have been filed related to these orders and similar executive orders, leading to confusion over the current state of the law on this issue. Restaurants and other businesses also face the prospect of an increase in lawsuits related to exposure to and contraction of COVID-19.
To help restaurants through this extremely challenging time, this presentation will focus on Executive Order Numbers 56 and 70, including the legal arguments being made for and against the orders, the potential impact of recent court rulings related to the orders, and the current status of legal challenges to the orders. The presentation also will address issues restaurants should consider when determining whether to allow in-person dining. This includes possible OSHA standards that might apply to COVID-19, types of lawsuits that could be filed against restaurants and other businesses by people that contract COVID19, and whether insurance would provide coverage for such lawsuits.
